Who we are
Neboda Group Pty Ltd (ABN 34 654 965 152) is a small company based in Queensland, Australia. In this policy, "we", "us" and "our" mean Neboda Group.
We source solar and energy storage equipment from manufacturers and connect them with buyers in business, government and remote areas. Our work covers matching products to projects, making introductions, checking certification and negotiating supply deals. We do not install equipment or perform any on-site or electrical work.
The Privacy Act 1988 (Cth) sets out the Australian Privacy Principles (APPs). Some small businesses are exempt from the Act. We have chosen to handle personal information in line with the APPs regardless, and this policy explains how.
What we collect
Personal information is anything that identifies you, or could reasonably be used to identify you. Most of what we hold is business contact details for people we work with or are in discussions with about a deal.
Through the forms on this website
Our contact form and partnership form ask for:
- First and last name
- Email address (the only required field)
- Organisation
- Phone number
- Postcode
- The topic you choose from the list
- Your message
Each calculator on our resources page has an "Email me a copy" option. If you use it, we receive your email address and a summary of your results. That summary includes the figures you entered, such as system size and postcode.
By email, phone or in person
When you email or call us, or meet us, we collect what you choose to tell us. This is usually your name, job title, company and contact details, along with information about your project or products. If you give us a business card, we keep its details.
About your project
To match products we often need details such as site location, equipment requirements, timing and budget. Manufacturers usually send product information and certification documents. Most of this is business information rather than personal information, but it may be linked to your name.
We do not ask for sensitive information such as health details, religion or political views. Please do not include it in a message. We do not take card payments through this website.
How we collect it
In most cases, directly from you, when you complete a form, send an email, call us or provide your details at a meeting.
Sometimes we get your details from someone else. A colleague might refer you to us, or a manufacturer or buyer might introduce us. We may also look at public sources such as your company website or LinkedIn. If we get your details this way and plan to keep them, we will tell you how we got them when we first contact you.
You can ask us general questions without giving your name. We do need a way to reply, however, and we cannot arrange an introduction or a deal for someone we cannot identify.
How we use it
We use your information to:
- reply to your enquiry
- work out what you need and find products or manufacturers that suit
- introduce you to a manufacturer or buyer, when you have asked us to help with a deal
- check certification and listing documents for products you are considering
- negotiate and manage a supply deal, including quotes, contracts and invoices
- email you a copy of your calculator results, when you ask for one
- keep business records and meet our legal obligations, such as tax
We do not sell personal information. We do not use it for any purpose unrelated to the reason you provided it, unless you agree or the law requires or allows it.
About introductions. Connecting buyers and manufacturers is the core of our work. If you are a buyer, we may give a manufacturer your name, company, contact details and project requirements so they can quote. If you are a manufacturer, we may give a buyer your contact details and product information. We only share what is needed to progress the deal you asked about, and we tell you who we are introducing you to before we pass your details on.
Sending information overseas
Some of the people and services we share information with are outside Australia.
Manufacturers. Many of the manufacturers we work with are based in China. Others may be elsewhere in Asia, or in Europe or North America. If you are a buyer and ask us to source equipment, we may send your details to a manufacturer in one of those places.
Service providers. Netlify and Google (which supplies the fonts on this site) are US companies and may process data in the United States and other countries. Microsoft may store our email data in Australia or overseas.
Before we send your details to an overseas manufacturer, we will tell you who they are and where they are based. Privacy law in that country may not protect your information the way Australian law does. If something goes wrong, you may not be able to take action in Australia under the Privacy Act. We send only what the manufacturer needs to respond to your enquiry, and we ask them to use it for that purpose only.
If you prefer your details to stay in Australia, tell us. We can often pass on your project requirements without your name or contact details and manage the conversation with the manufacturer ourselves.
Storage and security
We keep personal information in Microsoft 365, in our Netlify account and on our business devices. When you give us a business card, we add the details to our contacts.
This website uses HTTPS, so form submissions are encrypted on their way to Netlify. Our email and hosting accounts are protected by passwords and multi-factor sign-in, and only our directors have access to them.
No system is completely secure, so we cannot guarantee that information will never be lost or misused. If we become aware of a data breach that is likely to cause you serious harm, we will tell you, and we will notify the Office of the Australian Information Commissioner (OAIC) where the law requires it.
How long we keep it
- Enquiries that do not proceed. We keep these for up to two years after our last contact with you, in case the project resumes, and then delete them.
- Deal records. Quotes, contracts, invoices and related emails are kept for at least five years, because Australian tax law requires it.
- Form submissions in Netlify. Once a submission has reached our email, we clear it from Netlify on a regular basis.
When we no longer need information, we delete it or remove anything that identifies you.
Access and correction
You can ask for a copy of the personal information we hold about you, and ask us to correct anything that is wrong or out of date. Email beaudee@nebodagroup.com.au.
We may need to confirm who you are before we hand anything over. We will reply within 30 days and there is no charge. In rare cases the law allows us to refuse a request. If that happens, we will explain why in writing.
You can also ask us to delete your details. We will do that unless we need to keep them for a deal record or a legal reason.
Marketing
We do not send unsolicited marketing, and we do not buy or rent mailing lists. Sending an enquiry or requesting a calculator copy does not subscribe you to anything.
If we start sending news or updates in future, we will only send them to people who have agreed to receive them. Every message will include a simple way to unsubscribe. You can also reply and ask us to stop at any time.
Complaints
If you think we have mishandled your personal information, please tell us first. Email beaudee@nebodagroup.com.au with what happened and how you would like it fixed. We will confirm we have received it within five business days and aim to give you a full response within 30 days.
If you are not happy with our response, you can contact the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992. The OAIC usually expects you to raise the complaint with us before it steps in.
